<br />SUPPLEMENTAL AGREEMENT #28 (TWENTY-EIGHT) <br /> <br />This Supplemental Agreement, mClde as of the 6th day of March, 1997, by and between <br />the City of Roseville ("City") and BRW, Inc. also doing business as BRW Planning/Urban <br />Design, Transportation and Engineering ("Engineer"). <br /> <br />WHEREAS, the City and Engineer enter into an agreement ("the Prime Agreement") <br />which contemplates work by the Engineer on a project-by-project basis as specified by <br />Supplemental Agreement; and <br /> <br />WHERE the City desires that the Engineer conduct a supplemental traffic impact study <br />and air quality assessment for the proposed Centre Pointe Business Park. <br /> <br />NOW THEREFORE, City and Engineer hereby agree as follows: <br /> <br />1. Engineer agrees to provide professional services as detailed in the attached letter <br />proposal dated March 6, 1997. <br /> <br />2. City agrees to comply with its responsibilities under Section III of the Prime <br />Agreement to pay Engineer monthly for services on an hourly rate basis as <br />detailed below, and as specified in Section V(A)(l) of the Prime Agreement plus <br />reimbursable expense as specified in Section V (C). <br /> <br />3. Each part of the project shall not exceed the following amounts without prior <br />written approval: <br /> <br />Hourly Fee <br />N ot-to- Exceed <br /> <br />Everest Traffic Model Request <br />Traffic Impact and Air Quality Study <br />Expenses (Estimated) <br />Total <br /> <br />$ 250.00 <br />17,670.00 <br />150.00 <br />$ 18,070.00 <br /> <br />4. The schedule for ~ompleting work is as detailed in the attached letter proposal <br />dated March 6, 1997. <br /> <br />5. To the extent any items contain this Supplemental Agreement conflict with the <br />Prime Agreement, the Supplemental Agreement shall control for the project's <br />to be contemplated herein. <br /> <br />6.
