American Portable Telecom (APT) has been approved as the applicant for a Communication Tower Conditional <br />Use Permit. Final negotiations regarding the permanent site are contingent upon the city coming to conclusion on <br />negotiations with the St. Paul Water Utility for the purchase of the property. As we have indicated in the past, Sprint PCS <br />will be contributing to the construction cost of the multi-user site provided that the transaction is structured to be fair and <br />reasonable to all parties involved. <br /> <br />Since the city is still in the middle of negotiations regarding the property, Sprint PCS is requesting permission to construct <br />a temporary site and be allowed to operate from that site for up to 120 days with a possible extension of an additional 120 <br />days. Attached you will find diagrams showing how the site will be designed, the location of the site on the whole property <br />and how it is positioned respective to the possible permanent site. <br /> <br />The temporary site will consist of a 100' wood telephone pole,a metal platform to hold the computer equipment and <br />electrical details, along with a 6' chain link fence to secure the area. The electric and telephone will be brought in <br />overhead on the current lines already in place on the property. We would like to begin construction on the site as of <br />March 1 st, so that it will be operational by March 31, 1997. <br /> <br />Establishing this site is critical for us to meet the needs of Roseville residents, and of those conducting business and <br />enjoying the amenities in your community. The site will service major roadways such as Highway 36, Larpenteur Avenue <br />and Rice Street. Currently we are scheduled to launch our service during the month of April and constructing the site in <br />March will allow us to optimize the service without interruption to consumers once they begin using the system. <br /> <br />I have also attached for your review a final draft copy of the agreement between Sprint PCS and the St. Paul Water Utility. <br />Understandably the city may have liability concerns regarding the site and Sprint PCS is willing to add the city as an <br />additional insured on the certificate of insurance. In addition, Sprint PCS is willing to add a cross default clause in the <br />lease for the permanent site to insure that the temporary is removed when the permanent site is operational. <br /> <br />We would welcome the opportunity to further discuss any other details.
