REQUEST FOR PLANNING COMMISSION ACTION
DATE: 03/12/97
ITEM NO:
ent Approval: Manager Approved: Agenda Section:
Hearin s
Vacation ot Brenner 3rd Addition Easements and
Right-of-ways.

Background

1) When Centre Pointe Business Park was platted in the mid 1980's, The new plat
was "laid over the top" of a previous earlier plat called Brenner 3rd Addition. The
location of the plat was in the northwest portion of the current Centre Pointe plat. See
the attached map.

2) When attorneys reviewed the history of the business park, they uncovered the
old Brenner 3rd Addition Plat. The records of this plat are not clear, especially as it
relates to when (or if) the easements and the right-of-ways were ever vacated. A part of
this uncertainty is because nothing was ever recorded indicating the easements and
right-of-way was vacated.

3) In order to gain a clear title to the property, attorneys for the developers and
ultimate land owners have asked that the city vacate the easements and right-of-ways
for the record and have this action recorded against the property. A public hearing is
required and has been scheduled for the Planning Commission meeting on March 12,
1997.

Consistency with Zoning and Comprehensive Plan

1) The vacation of old or unused easements and right-of-ways makes for more
efficient land use. It has no impact upon the zoning or comprehensive plan designation.

Description of the Current Request

1) The developers simply request that the old unused easements and right-of-ways
be officially vacated to allow for clear title so that the next stage of subdivision and/or
redevelopment in the business park to proceed.

1
