<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 04/08/97 <br />ITEM #: PF 2884 F-l <br />Agenda Section: <br />Re orts <br />Vacation 0 renner 3rd Addition Easements and <br />Right-ot-ways. <br /> <br /> <br /> <br />Background <br /> <br />1) When Centre Pointe Business Park was platted in the mid 1980's, the new plat <br />was "laid over the top" of a previous earlier plat called Brenner 3rd Addition. The <br />location of the plat was in the northwest portion of the current Centre Pointe plat. See <br />the attached map. <br /> <br />2) Recently, attorneys reviewing the history of the business park uncovered the old <br />Brenner 3rd Addition Plat. The records of this plat are not clear, especially as it relates <br />to when (or if) the easements and the right-of-ways were ever vacated. A part of this <br />uncertainty is because nothing was ever recorded indicating the easements and right- <br />of-way was vacated. <br /> <br />3) In order to gain a clear title to the property, attorneys for the developers and <br />ultimate land owners have asked that the city vacate the easements and right-of-ways <br />for the record and have this action recorded against the property. A public hearing is <br />required and has been scheduled for the Planning Commission meeting on March 12, <br />1997. <br /> <br />Consistency with Zoning and Comprehensive Plan <br /> <br />1) The vacation of old or unused easements and right-of-ways makes for more <br />efficient land use. It has no impact upon the zoning or comprehensive plan designation. <br /> <br />Description of the Current Request <br /> <br />1) The Ryan attorneys simply request that the old unused easements and right-of- <br />ways be officially vacated to allow for clear title so that the next stage of subdivision <br />and/or redevelopment in the business park to proceed. <br /> <br />1 <br />
