<br />Assi~ent. Buyer may not assign the Buyer's interest in this Option to a third party without <br /> <br />the express written consent of the Seller. <br /> <br />Memorandum of Agreement. Seller and Buyer agree that upon the request of either party, <br /> <br />they will execute a memorandum of this Option which shall be in recordable fonn and shall set forth <br /> <br />Buyer's rights to purchase the Property. <br /> <br />Tennination of Option by Buyer. Buyer may tenninate this Option at any time during the <br /> <br />tenn of this Option by giving 10 day written notice to Seller and delivering a fully executed <br /> <br />recordable quit claim deed for the Property. Seller will retain all option fees as liquidated damages. <br /> <br />Arbitration. Any controversy or claim arising out of or relating to this Option, or the breach <br /> <br />thereof, shall be settled by arbitration in accordance with the construction industry arbitration rules <br /> <br />of the American Arbitration Association, and providing further, said agreement to arbitrate shall <br /> <br />survive the closing herein, and judgment upon any award rendered by the arbitrators may be entered <br /> <br />in any court having jurisdiction thereof. <br /> <br />CQpies of Surveys. etc, Seller agrees to provide Buyer with copies of any survey, previous <br /> <br />applications for plat approval, decision on plat approval, surveys, testing reports or other documents <br /> <br />Seller has obtained or prepared in conjunction with the Property. <br /> <br />Notices.
