Ownership of Improvements <br /> <br />Upon comptetion and City acceptance of the work and construction required by this <br />Contract, the pubic improvements lying within public rights-of-way and easements <br />shaH become City property provided the following takes place: <br /> <br />A. Devetope(s engineer submits an application for acceptance. The appfication <br />shaW Mclude certification that all improvements were compteted accotding to <br />the approved ptans and specifications. <br /> <br />B. As-built plans are submitted to the City's Engineering Department. <br /> <br />C. The Developer posts a two year warranty bond as noted in paragraph (16) <br />befow. <br /> <br />D. The City Council passes a resolution accepting the project. <br /> <br />17. <br /> <br />Wamnty <br /> <br />w~ <br />The Developer ~3R8f1tits all work required to be performed by it against poor <br />materia' and faulty workmanship for a period of two (2) years after its comptetion <br />and acceptance by the Cily. AD trees, grass and sod shan be warranted to be alive, <br />of good quality and disease free for twefve (12) months after ptanting. The <br />Developer shaft post maintenance bonds or other security acceptable to the City to <br />secure the warranties. <br /> <br />18. <br /> <br />Responsibirlfy for Cosa <br /> <br />A. <br /> <br />B. <br /> <br />E)(oopt as otherwise specified herein, the Developer shall pay all costs <br />incurred by it or the City in conjunction with the devetopment of the plat <br />including, bllt not limited to, Soil and Water Conservation District charges, <br />legal, pianning, engineering and inspection expenses incurred in connection <br />with approval and acceptance of the plat, the preparation of this Contract, <br />and all costs and expenses incurred by the City in monitoring and inspecting <br />development of the plat. ~ o---fJ. <br /> <br />The Devetoper shaHrr;td the City and its officers and employees hannfess <br />from claims made by itseff and third parties fOf damages sU$tained or costs <br />incurred resufting from ptat approval and developn tent. The Devetoper shall <br />indemnify the City and its officers and employees for an costs, damages or <br />expenses which the City may payor incur in consequence of such claims, <br />including attomeyfs fees. <br />
