<br />..,". <br /> <br /> <br />AGREEMENT, dated April 28, 1997, between the City of Roseville (" City") and Southwind <br />of Roseville, L.L.C. ("Developer"). <br /> <br />1. Request for Planned Unit Development Approval <br /> <br />The DEVELOPER has asked the CITY to approve a Planned Unit Development <br />(PF#2885) consisting of 32 townhomes, to be developed in two phases, on approximately <br />6.0 acres of land generally located south of County Road B and adjacent to Albemarle <br />Court. The subject property is legally described as follows: <br /> <br />The plat of Southwind of Roseville, also legally described as: Lots 3, 4, 5, 6, and 8 <br />through 15, Block 1, Zeece Addition, according to the recorded plat thereof; and that <br />part of Albemarle Court, as dedicated in Zeece Addition, Ramsey County, <br />Minnesota, vacated per Resolution No. 9407; and Lot 1, Thornton's Subdivision of <br />the Northeast Quarter of Section 13, Township 29, Range 23, except that part of the <br />North 150 feet of said Lot 1 lying Easterly of the West 80 feet of said Lot 1, and <br />except the South 240 feet of said Lot 1, and except the East 147 feet of said Lot 1; <br />subject to easement. <br /> <br />2. Planned Unit Development Approval <br /> <br />The CITY hereby grants approval of the final development plan which is subject to the <br />DEVELOPER's compliance with the terms and conditions of this agreement. The CITY <br />agrees to approve applications for building permits, provided that said plans are consistent <br />with the exhibits which were approved at the concept and final stage of the Planned Unit <br />Development process, and all of the standards and' conditions of this agreement have been <br />satisfied . <br /> <br />3. Approval by the CITY <br /> <br />The CITY hereby approves the Development as shown on the following exhibits. The <br />DEVELOPER shall develop the subject properties in accordance with the general plans <br />shown on the exhibits. If, however, the exhibits vary from the written terms of this <br />Agreement, the written terms shall control. The exhibits marked approved by the City <br />Council on April 28, 1997, or as amended thereafter, shall include: <br />
