<br />AGREEMENT <br /> <br />BETWEEN <br /> <br />RAMSEY COUNTY & NORTHERN STATES POWER <br /> <br />This Agreement, by and between County of Ramsey, a body <br />politic and corporate under the laws of the State of <br />Minnesota, hereinafter referred to as the "COUNTY" and <br />Northern States Power Company, a corporation under the laws <br />of the State of Minnesota, hereinafter referred to as "NSP". <br /> <br />WITNESSETH: <br /> <br />That the COUNTY does hereby enter into an Agreement with <br />NSP for utilization of a portion of the COUNTY's Kent Street <br />si.te based on the following terms and conditions: <br /> <br />1. That NSP's line clearance contractors will be <br />allowed to drop chips and tree limbs, branches and <br />trunks at the site in a designated area. <br /> <br />2. That NSP will supply and operate a tub grinder, and <br />associated machinery such as loaders and trucks, at <br />the site to process the tree limbs, branches, trunks <br />and chips if necessary into usable landscape mulch <br />for use by the COUNTY and NSP. <br /> <br />3. That NSP will be allowed to stockpile good quality <br />chips/mulch for use at a later date by the COUNTY <br />and NSP. <br /> <br />4. That NSP will process tree material brought to the <br />site by the COUNTY, not to exceed 120 hours of <br />grinding time annually. If the COUNTY has <br />additional material to be processed, NSP will charge <br />a rate of $300.00 per hour, including all machinery <br />and labor, for hours in excess 120. <br /> <br />5. That NSP will process/grind tree limb material at <br />the site no less than four (4) times per year. <br />Unprocessed tree limb material will sit no longer <br />than 120 days. <br /> <br />6. Tree limbs dropped off by the COUNTY for processing <br />by NSP should be no greater than 8 feet in length <br />and cannot include tree stumps. All tree material <br />must be free of metal and any other foreign objects. <br /> <br />7. That NSP's line clearance contractors be allowed to <br />park up to ten (10) work vehicles at the site, or at <br />a nearby site designated by the COUNTY.
