<br />recyclable materials and shall favor the purchase of <br />recycled products in its procure processes. All <br />reports, publications and documents produced as a <br />result of this Agreement shall be printed on both <br />sides of the paper, where commonly accepted <br />practices allow, on recycled and recyclable paper <br />using soy-based inks, and shall be bound in a manner <br />that does not use glue. <br /> <br />16. Non-Violence. That NSP shall make all reasonable <br />efforts to ensure that NSP's employees, officials <br />and contractors do not engage in violence while <br />performing under this Agreement. Violence, as <br />defined by the COUNTY Workplace Violence Policy, is <br />any action that is the use of physical force, <br />harassment, or intimidation or abuse of power or <br />authority where the impact is to control by causing <br />pain, fear or hurt. <br /> <br />17. Workforce Diversity. NSP shall make good faith <br />efforts throughout the term of the Agreement, and <br />any extensions thereof, to employ persons of color <br />for all classifications of work under this <br />Agreement, and shall, on an annual basis, submit a <br />written report to the COUNTY regarding the efforts <br />and results of such efforts, including employment by <br />job classification. <br /> <br />18. Subcontractor Payment. In the event that NSP <br />subcontracts its obligations in this agreement, the <br />following provision shall apply: Prime contractors <br />shall pay any subcontractor within ten days of the <br />prime contractor's receipt of payment from the <br />COUNTY for undisputed services provided by the <br />subcontractor. The prime contractor shall pay <br />interest of 1 1/2 percent per month or any part of a <br />month to the subcontractor on any undisputed amount <br />not paid on time to the subcontractor. The minimum <br />monthly interest penalty payment for an unpaid <br />balance of $100 or more is $10. for an unpaid <br />balance of less than $100, the prime contractor <br />shall pay the actual penalty due to the <br />subcontractor. A subcontractor who prevails in a <br />civil action to collect interest penalties from a <br />prime contractor must be awarded its costs and <br />disbursements, including attorney's fees, incurred <br />in bringing the action. <br />
