<br />Section 2. Association Acts throuQh Board. The power and authority of the <br />Association as provided in the applicable Statutes, the Declaration, By- <br />Laws, Rules and Regulations shall be vested in a Board of Directors <br />elected by the owners in accordance with the By-Laws of the Association. <br />The Association shall act through the Board of Directors and the officers <br />elected by the Board; accordingly, all references in this Declaration and <br />the By-Laws to action by the Association shall mean the Board of <br />Directors acting for the Association, unless action by the vote of the <br />owners, members or mortgagees, is expressly required by the Declaration <br />or By-Laws. <br /> <br />Section 3. Notices. Any notice required to be sent to any member of the <br />Association (or owner) under the provisions of this Declaration shall be <br />deemed to have been property sent when mailed, postage pre-paid, to <br />the last known address of such member appearing on the records of the <br />Association at the time of such mailing. In case of multiple owners of <br />a Unit, notice to anyone of such owners shall be deemed notice to all. <br /> <br />Section 4. Captions. The headings in this Declaration are intended for convenience <br />only and shall not be given any substantive effect. <br /> <br />Section 5. Construction. In the event of any apparent conflict between this <br />Declaration and the By-Laws, provisions of this Declaration shall govern. <br />The use of pronouns such as "his", "he" and "him" are for literary <br />purposes and mean whenever applicable the plural and female forms. <br /> <br />Section 6. Not Subiect to Ordinance. This property is not a conversion. <br /> <br />Section 7. Riahts of Action. In addition to all other remedies and rights set forth <br />in the Act, the Association, and anyone or more aggrieved Unit owners, <br />shall have the right of action against the Unit owners who fail to comply <br />with the provisions of the Declaration and By-Laws or the decisions of <br />the Association, and one or more Unit owners shall also have such rights <br />of action against the Association for any failure to comply with or enforce <br />such provisions. <br /> <br />Section 8. Declarant's Riahts and Obliaations. The Declarant shall enjoy the same <br />rights and shall be deemed to have assumed the same duties with <br />respect to its unsold Units in the condominium as any other owner, <br />except as modified or extended by the alternate assessment program and <br />special Declarant rights described in this Declaration. <br /> <br />17 <br />
