<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br /> <br />DATE: 07/26/99 <br />ITEM NO: G-l <br /> <br />Agenda Section: <br />Ret'orts <br /> <br />Mendota Homes - Request for an extension to their previously approved <br />Planned Unit Development/Subdivision Agreement #1197. (PF #2891) <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />Mendota Homes seeks an extension to their previously approved Planned Unit <br />Development/Subdivision Agreement (#1197) regarding construction of a 30 unit senior housing <br />condominium complex. <br /> <br />2.0 REVIEW of REQUEST <br /> <br />2.1 On February 8, 1998 the Roseville City Council approved the terms and conditions of the <br />proposed development, which requirements are contained in the PUD/Subdivision <br />Agreement. Section 6.0, Development of Property, of the PUD agreement states: <br /> <br />Failure by the DEVELOPER to commence development activity, in accordance <br />with the final development plans, within one (1) year following the final approval <br />of this Planned Unit Development, will necessitate the approval of an extension of <br />the development schedule by the City Council prior to the expiration of the one <br />year period. If an extension is not applied for, the City Council may instruct the <br />Planning Commission to initiate rezoning to the original R-l zoning district. For <br />the purpose of this provision, development activity shall be defined as obtaining a <br />building permit and beginning construction on the site. <br /> <br />2.2 A considerable amount of time has elapsed since the agreement was approved, during <br />which time period Mendota Homes has aggressively been seeking financing for Phase I <br />while working with the City on starting construction of the Phase 130 unit project and <br />completion of Phase II. <br /> <br />2.3 Mendota Homes requests a 90 day extension, allowing them to close on the property and <br />financing, and to obtain grading and footing permits for construction. <br /> <br />3.0 STAFF RECOMMENDATION <br /> <br />Given the difficulties in securing financing for this development staff recommends approval of <br />the request for a 90 day extension to Planned Unit Development/Subdivision Agreement # 1197 <br />for Mendota Homes. <br /> <br />PF2891- RCA (072699) PUD Agreement Extension.doc Page 1 of2 <br />
