You also enclosed copies of <br />correspondence from previous City Attorney Roger A. Jensen dated February 12, <br />1997 and September 22, 1997 relating to this matter. <br /> <br />While I have not had the opportunity to review the letter and statements <br />previously submitted by the attorney for Indianhead Truck Line which are referenced <br />in Mr. Jensen's letters, I concur with Mr. Jensen's legal analysis that a lessee or <br />purchaser is generally authorized to continue a preexisting non-conforming use. <br /> <br />If, however, there is a break in the non-conforming use, or if the use was never <br />established, then the proposed conduct of any sale or leasing activity constitutes an <br />illegal use of the property. <br /> <br />At this time, the City has no information which warrants a change in the City's <br />position, enunciated in an April 18 letter to Mr. Roger Wilsey ofIndianhead <br /> <br />Suite 317 .
