August 9, 1996

To:

Mike Falk, City Planner

)~m:

Rick Jaehnert, Code Enforcement

RE:

Indian Head rezoning at 1947 W. County Road C

History

On August 16, 1972, The Village of Roseville's City Council approved the rezoning of
that property located at 1947 W. County Road C from 1-1 (Limited Industry) to 1-2 (General
Industry). Also, the Council approved a special use permit to allow Indian Head Trucking
Company to build a motor freight tenninal at the above mentioned location.

In 1986, Indian Head Trucking was discussing the sale of their property to a wholesale
supply company called Costco Wholesale, Incorporated. In order for Costco to conduct
wholesale business on this site, the property had to be rezoned from General Industry to Retail
Office Service.

On August 11,1986, Roseville's City Council approved the site at 1947 W. County Road
C to be rezoned from 1-2 (General Industry) to B-4 (Retail Office Service).

A purchase agreement between the two companies was never signed, and in 1987, Indian
Head Trucking decided against selling their property to Costeo. In September of the same year,
Indian Head's attorney requested that Roseville's City Council nullify ordinance #1001 and
immediately restore the property to its Industrial zoning classification. Indian Head's attorney
claimed that the property was rezoned based upon erroneous information and without proper due
process for a city-initiated rezoning.

The City of Roseville's planning staff informed Indian Head Trucking that the only way
tins property can be rezoned for an industrial use again is for the company to go through the
rc~zoning process.

Current Status

The above mentioned site is currently zoned B-4 (Retail Office Service) and is now
guided for business purposes in the City's Comprehensive Plan. Indian Head Trucking
Company is still located on this parcel and is a legal non-confonning business.
