You responded by contacting me to discuss the matter, then followed-up by providing an
e-mail reviewing your understanding of the variance and the current situation.
Unfortunately, there is no way to resolve the matter without either completing the work
or receiving an amendment to the variance.

By law, you are bound to the three conditions stipulated in the resolution approving the
variance. Should you choose not to complete any condition, the city can seek legal
action. It is in your best interest to either complete the required work or submit an
application for an amended variance.

The process for amending your variance requires completion (applicable sections) of the
attached application, submittal of a narrative describing the reason for the request, and
appropriate fees. The city will process the application and set a hearing date to consider
the request.

Should you determine to not apply for a variance amendment, please note completion of
condition number one should occur in a reasonable time. Given the season, the city has
placed a deadline of May 31, 2000 for you to complete condition one or receive a
variance amendment. If either action is not complete by this date, the matter will be
forward to the City Attorney for enforcement.

Please feel tree to call me at 651.490.2236 if you have any questions regarding this letter
or the variance amendment process.

Attachment:

Q:\General Correspondence\ThomasP\Paul Dunn Letter 2.doc
