<br />ASSESSMENT AGREEMENT <br /> <br />THIS AGREEMENT made and entered into by and between the City of Roseville <br />("City") and David Booms and Lisa Booms ("Booms") regarding the property located at 300 <br />South McCarrons Boulevard, in the City of RoseviHe. <br /> <br />WHEREAS, the Booms own the property located at 300 South McCarrons Boulevard <br />in the City ofRoseville, and have an existing garage located immediately adjacent to the road <br />right-of-way. <br /> <br />WHEREAS, the City wilt be repaving South McCarrons Boulevard as part of a public <br />improvement project. <br /> <br />WHEREAS, the City's road reconstruction wiU be better accommodated if the Booms <br />garage is reconstructed at a location set back from the road right-of-way. <br /> <br />WHEREAS, the parties desire to enter into this agreement whereby the relocation of the <br />garage may be accomplished and the cost of construction wiU be financed through a special <br />assessment. <br /> <br />NOW, THEREFORE, it is hereby agreed by and between the parties as follows: <br /> <br />1, The existing garage on the Booms' property wi11 be removed and disposed of by <br />the City's contractor as part of a road reconstruction public improvement project, <br />P-97-03, thetotaJ cost of which removal and disposal shall not exceed $1,80000, <br />By signing this agreement the Booms waive any trespass necessary for the <br />contractor to complete the removal of the existing garage, <br /> <br />2. The City's contractor will remove trees, excavate and prepare the ground at a <br />mutually agreeable location on the Booms' property, sufficient to accommodate <br />the new garage, the totaJ cost of which tree removal and ground preparation work <br />shall not exceed $1,050.00. <br /> <br />3. The City's contractor will relocate the existing water service for the residence to <br />a location which will not conflict with the proposed garage. The cost of relocating <br />the water service shall not exceed $750.00. <br /> <br />4. The City's contractor will relocate the existing sewer service for the residence to <br />a location which will not conflict with the proposed garage. The cost. of relocating <br />the sewer service shalt not exceed 5850.00. <br /> <br />5. Both parties understand that the work performed by the City's contractor may <br />have an adverse effect on the existing stairs leading from the residence to the <br />existing garage. The City's contractor will use caution when working near the <br />stairs, but the City and its contractor shall not be held liable for any damage to the <br />stairs resulting from the work to be performed, <br />
