<br />REQUESTFORCOUNC~AcnON <br /> <br />DATE: 07/28/97 <br />ITEM NO: <br /> <br /> <br />Manager Approved: Agenda Section: <br />LAND USE <br />CB Commercial request for a conditional use permit to allow the <br />placement of a commercial communications tower on a non-City <br />tower site at 2582 Long Lake N (PF#2929). <br /> <br />~ REQUESTED ACTION <br /> <br />1.1 CB Commercial is requesting a conditional use permit to allow the placement of a <br />commercial communications tower on a non-City tower site at 2582 Long Lake <br />Road. The conditional use permit process for this request allows the City to <br />consider compatibility with adjoining properties; impacts on traffic, public facilities, <br />and property values; impact on the general health, safety, and public welfare; and <br />compatibility with the City's comprehensive plan. The process also allows the City <br />to impose those conditions it considers necessary to protect the public health, <br />safety, and welfare. <br /> <br />2J1 BACKGROUND <br /> <br />2.1 CB Commercial has a lease agreement to locate a 90 foot monopole tower on <br />property at 2582 Long Lake Road, which is owned by John and Pearl Johnson. The <br />property is located in a B6 Office Park District, and the Comprehensive Plan <br />identifies this property as Commercial. Adjacent land uses include railroad right-of- <br />way and an office park to the north; a petroleum tank farm to the west; a trucking <br />terminal to the south; and 1-35W to the east. <br /> <br />2.2 CB Commercial is requesting a conditional use permit to allow the placement of a <br />commercial communications tower on a non-City tower site. The applicant intends <br />to construct a 90 foot high monopole tower in the southeast corner of the property, <br />with commercial receiving and transmitting antennas on top of the tower. <br /> <br />2.3 An elevation of the proposed monopole, service coverage maps with and without <br />this site, the applicant's description of why it is not technically feasible to locate <br />antennas on a city owned or controlled site, and a description of CDMA technology <br />have been provided by the applicant and are attached to this report. <br /> <br />2.4 Section 1012.10 of the City Code states that commercial receiving and transmitting <br />towers not located on a City tower site are only allowed as a conditional use. <br />Commercial receiving or transmitting antennas and towers may only be located in <br />Business or Industrial Districts.
