<br />provided such assessment is evenly applied and credit is given for any previous payments, if any, <br />and any piping or drainage channels necessary to direct water from the Allen Fairview Avenue <br />property to pond. <br /> <br />3.3 The City of Roseville accepts no responsibility for the design of the pond as current <br />proposed and approved by the Rice Creek Watershed. <br /> <br />3.4 Fairview H.A. and successors agree to maintain and continue the functionality of the <br />storm water pond in the original condition as stipulated in the design approved by Rice Creek <br />Watershed until such time as an alternative site for ponding becomes available. <br /> <br />3.5 Fairview H.A. agrees that it will cooperate in good faith with the City and Pacific Mutual <br />Door to explore and implement a shared driveway for Fairview H.A. and Pacific Mutual Door on <br />the northerly property line of Fairview H.A. and the southerly property line of Pacific Mutual <br />Door. Provided, however, any such driveway will not reduce paving for Fairview H.A.'s <br />property or diminish the developments value or cause safety concerns. Any such shared <br />driveway must provide for equal area contribution by both Fairview H.A. and Pacific Mutual <br />Door. <br /> <br />4 <br />
