<br />,. <br />...- ' <br /> <br />NO DELINQUENT TAXES <br />AND TRANSFER ENTERED <br /> <br />NOV 06 1997 <br /> <br />DRAINAGE AND UTILITY EASEMENT <br />05-14-1-80(''' <br /> <br /> <br />Dip!. of Pr <br /> <br />B TH S , ma this ~ day of~TCJM~ 1997, by and between RYAN TWIN <br />LAKES LIMITED PARTNERSmp, a Minnesota limited partnership ("Ryan") and the CITY OF <br />j ROSEVILLE, Ramsey County, Minnesota, a municipal corporation ("City"). <br /> <br />WITNESSETH: That in consideration of the sum of One Dollar ($1.00) and other good and <br />valuable consideration in hand paid by the City, Ryan does hereby grant and convey unto City, its <br />successors and assigns, a perpetual non-exclusive easement for drainage and utility purposes under, <br />over and across the following described property in Ramsey County, Minnesota: <br /> <br />A 20 foot wide Drainage and Utility Easement over, under and across that part of <br />Lots 1 and 2, Block 3, Centre Pointe Business Park, according to the recorded plat <br />thereof, Ramsey County, Minnesota, the centerline described as follows: <br /> <br />Commencing at the northeast corner of said Lot 1; thence South 00 degrees 00 <br />minutes 00 seconds East, assumed bearing, along the east line of said Lot 1, a <br />distance of 348.53 feet to the beginning of the centerline to be described; thence <br />South 46 degrees 46 minutes 22 seconds West, a distance of 133.23 feet; thence <br />North 45 degrees 26 minutes 27 seconds West, a distance of 147.08 feet; thence <br />South 44 degrees 33 minutes 33 seconds West, a distance of 144.01 feet; thence <br />South 89 degrees 02 minutes 20 seconds East, a distance of 76.41 feet to the west <br />line of said Lot 2 and said centerline there terminating. <br /> <br />The sidelines of said easement are to be prolonged or shortened to tenninate at said <br />East line of Lot 1 and said west line' of Lot 2. <br /> <br />which easement shall include the perpetual rights of said City>> its successors or assigns, to construct, <br />maintain, operate and repair any drainage and utility lines under, over and across the strip of land <br />hereinbefore described, together with a non-exclusive perpetual easement for ingress and egress over <br />the above described property, all without additional compensation. <br /> <br />City will indemnify, save, defend and hold Ryan, its successors and assigns>> from any and all claims <br />by any person for any personal injury or property damage, made as a result of the use of any <br />drainage and utility lines or easement which is the subject qf this Easement.
