<br /> <br /> <br />Ma Agenda Section: <br />CONSENT <br /> <br />Ryan Companies US, Inc., request for release of drainage and utility <br />easement and acceptance of a modified drainage and utility <br />easement from Ryan Companies US, Inc. for Centre Pointe Phase II <br />(PF#2947a). <br /> <br /> <br />1.Jl REQUESTED ACTION <br /> <br />1.1 Ryan Companies US, Inc. is requesting the City to release a drainage and utility <br />easement (05-14-18) for sanitary sewer purposes across part of Lots 1 and 2, Block <br />3, Centre Pointe Business Park (Centre Point Phase II) and accept a modified <br />drainage and utility easement (05-14-26) for sanitary sewer purposes across part <br />of Lots 1 and 2, Block 3, Centre Pointe Business Park (Centre Point Phase II). The <br />requested actions will accommodate a re-routed sanitary sewer line within an <br />accurately described drainage and utility easement. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 In September 1997, the City vacated a drainage and utility easement adjacent to <br />the common boundary of Lots 1 and 2, Block 3, Centre Pointe Business Park, in <br />order to accommodate the development of Centre Pointe Phase II. In conjunction <br />with the vacation, the City accepted a new drainage and utility easement. The re- <br />routed utilities were to be located within this new easement. <br /> <br />2.2 During the preparation of the as-built survey in December 1997, it was discovered <br />that a portion of the re-routed sanitary sewer line was constructed outside of the <br />drainage and utility easement granted to and accepted by the City. This was the <br />result of a slight error in the original survey regarding the location of a sanitary <br />sewer manhole. <br /> <br />2.3 In January 1998, it was also discovered that an error had been made in the legal <br />description of the easement accepted by the City in September 1997 and <br />subsequently recorded. The easement, which was provided to the City by Ryan <br />Companies US, Inc., had two errors in directionals; therefore, the easement as <br />described does not accurately reflect the easement as required. <br /> <br />2.3 In order to correct these errors in the most expedient manner, Ryan Companies US, <br />Inc. is requesting the release of the existing easement (accepted in September <br />1997) and acceptance of a modified easement which accommodates the re-routed <br />sanitary sewer line and corrects the legal description. <br /> <br />RCA (PF2947a) - 03/10/98 - Page 1 of 2 <br />
