<br />Ul STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff has made the following findings: <br /> <br />1. A 20 foot utility and drainage easement over, under, and across Lots 1 and <br />2, Block 3, was dedicated on the plat of Centre Pointe Business Park. <br /> <br />2. The combination of a portion of Lot 1, Block 3, with Lot 2, Block 3, resulted <br />in the utility and drainage easement being located in the middle of a <br />buildable parcel. <br /> <br />3. This utility and drainage easement contains a sanitary sewer line. <br /> <br />4. In order to develop this parcel as proposed, the existing utility easement will <br />need to be vacated, a new easement will need to be accepted, and the <br />existing sanitary sewer line will need to be moved to the new easement. <br /> <br />5. The proposed vacation of the existing utility and drainage easement and the <br />acceptance of a new sanitary sewer easement will not have an adverse <br />impact on the general public health, safety and welfare. <br /> <br />6. The proposed vacation of the existing utility and drainage easement and the <br />acceptance of a new sanitary sewer easement will facilitate the development <br />of Centre Pointe Business Park as approved by the City Council. <br /> <br />4JJ STAFF RECOMMENDA TION <br /> <br />4.1 Based on the findings outlined in Section 3.1 of this report, staff recommends <br />approval of the request for vacation of a 20 foot drainage and utility easement <br />dedicated on the plat of Centre Pointe Business Park. <br /> <br />~ SUGGESTEDACnON <br /> <br />5.1 By motion, recommend approval of the request for vacation of a 20 foot drainage <br />and utility easement dedicated on the plat of Centre Pointe Business Park, based <br />on the findings outlined in Section 3.1. <br /> <br />Attachments: notification map; notice of public hearing; legal description sketch of existing and proposed <br />easements; petition for vacation of easement; and petition for acceptance of easement. <br /> <br />60-clay Time Limit: application submitted on August 11, 1997; application accepted as complete on August <br />21,1997; decision deadline is October 20,1997. <br /> <br />Prepared by: Kim L.
