CONSENT <br />Item Description: Ryan Companies US, Inc., acceptance of an additional drainage and <br />utility easement from Ryan Companies US, Inc. for Centre Pointe <br />Phase II (PF#2947a). <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Ryan Companies US, Inc. is requesting the City to accept an additional drainage <br />and utility easement for sanitary sewer purposes across part of Lots 1 and 2, Block <br />3, Centre Pointe Business Park (Centre Point Phase II). This additional drainage <br />and utility easement will accommodate a re-routed sanitary sewer line and correct <br />an error in the original easement accepted by the City in September 1997. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 In September 1997, the City vacated a drainage and utility easement adjacent to <br />the common boundary of Lots 1 and 2, Block 3, Centre Pointe Business Park, in <br />order to accommodate the development of Centre Pointe Phase II. In conjunction <br />with the vacation, the City accepted a new drainage and utility easement. The re- <br />routed utilities were to be located within this new easement. <br /> <br />2.2 During the preparation of the as-built survey in December 1997, it was discovered <br />that a portion of the re-routed sanitary sewer line was constructed outside of the <br />drainage and utility easement granted to and accepted by the City. This was the <br />result of a slight error in the original survey regarding the location of a sanitary <br />sewer manhole. <br /> <br />JJ2 SUGGESTED CITY COUNCIL ACTION <br /> <br />6.1 By motion, accept the conveyance of an additional easement to the City from Ryan <br />Companies US, Inc., as described in the attached drainage and utility easement <br />(05-14-26). <br /> <br />Attachments: letter from Ryan Companies US, Inc.; original drainage and utility easement; survey showing <br />proposed drainage and utility easement; and new drainage and utility easement. <br /> <br />60-day Time Limit: Not applicable <br /> <br />Prepared by: Kim L.
