WITNESSETH: That in consideration of the sum of$1.00 and other valuable considerations in hand paid by the said party of the second part, said parties of the first part do hereby grant and convey unto party of the second part, its successors and assigns, a perpetual easement for a public road'and highway and for underground utility mains, pipes and appurtenances under and across the f.ollowing described property in Ramsey County, Minnesota: THE EASTERLY 16.5 FEET OF THE WESTERLY 49.5 FEET OF THAT PART OF THE NORTHWEST QUARTER OF THENORTBWEST QUARTER OF SECTiON 4, TOWNSHIP 29, RANGE 23, RAMSEY COUNTY, MINNESOTA LYING SOUTHERLY OF THE RECORDED PLAT OF WHITE OAK HILLS NO.2 ACCORDING TO THE PLAT ON FILE AND OF RECORD IN THE OFFICE OF THE COUNTY RECORDER. which easement shall include the perpetual rights of said City ofRoseviUe, its successors or assigns, to grade, level, fill, drain, pave, build, maintain, and rebuild or widen a public road or highway, together with such culverts, cuts, or ditches as may be necessary, and to construct, maintain, operate and repair underground utility mains, pipes and appurtenances over and across a strip of land hereinbefore described, together with perpetual easement for ingress and egress, all without additional compensation. TO HAVE AND TO HOLD THE SAME, together with all the hereditaments and appurtenances thereunto belonging, or in anywise appertaining, to the said party of the second part, its successors and assigns, forever.
