The City's Comprehensive Plan text does not specifically address this parcel; <br />however, it is the policy of the City to discourage the encroachment of <br />commercial uses into residential neighborhoods. The transfer of the west .54 <br />acres of the parcel to the adjacent parcel, along with the designation of the <br />.54 acres as high density residential and the rezoning of the parcel to R3A, <br />will remove the commercial encroachment into a residential area. <br /> <br />3. A minor subdivision to transfer this property from 2075 Snelling Avenue <br />North (McDonald's -land owned by applicant) to 2096 Fry Street North (four- <br />plexes - land owned by applicant) was approved by the City Council on <br />September 8, 1997, subject to approval of a comprehensive plan <br />amendment and rezoning of the parcel. <br /> <br />4. The proposed comprehensive plan amendment is in harmony with the <br />general purpose and intent of the City's Comprehensive Plan and Title 10 of <br />the City Code (Zoning). <br /> <br />5. The proposed comprehensive plan amendment will not adversely affect the <br />public health, safety, or general welfare. <br /> <br />4J1 STAFF RECOMMENDA TION <br /> <br />4.1 Based on the findings outlined in Section 3.1 of this report, staff recommends <br />approval of the request for a comprehensive plan amendment to change the <br />designation of the west .54 acre of the parcel located at 2075 Snelling Avenue <br />North from Business to High Density Residential. <br /> <br />~ SUGGESTEDAcnON <br /> <br />5.1 By motion, recommend approval of the request for a comprehensive plan <br />amendment to change the designation of the west .54 acre of the parcel located at <br />2075 Snelling Avenue North from Business to High Density Residential, based on <br />the findings outlined in Section 3.1. <br /> <br />5.2 By motion, recommend that the minor subdivision approval be re-affirmed by the <br />City Council, with the following provisions: <br /> <br />1. A 20 foot wide private utility easement for water service must be dedicated <br />in the appropriate location within the.54 acre parcel being transferred <br /> <br />2.
