MEMORANDUM

FROM:

Dennis Welsch, Community Development Director
Kim Lee, City Planner ~

DA TE:

September 19, 1997

SUBJ:

Minor Subdivision of 2401 and 2403 Brenner Court (PF#2959)

The purpose of this memo is to provide you with an overview of the request for a minor
subdivision of the property located at 2401 and 2403 Brenner Court. This property is
located in an R-2, Two Family District, and is designated as Low Density Residential in the
City's Comprehensive Plan.

A building permit was issued for a twinhome in this location in May 1997. Plan Reviewer
Marty Hanson has indicated that the construction does meet Uniform Building Code
requirements for a zero lot line subdivision as proposed.

Section 1004.03D of the City Code requires a front yard setback of 30 feet, a side yard
setback of 10 feet, and a rear yard setback of 30 feet in an R-2 zoning district. The
minimum lot width, depth, and area requirements have not historically been applied to
common wall duplex subdivisions.

Section 11 04.04A of the City Code outlines the requirements for a common wall duplex
subdivision. This type of minor subdivision is limited to a common wall duplex minor
subdivision of a parcel in an R-2 District or other zoning district which allows duplexes,
along a common wall of the structure and common lot line of the principle structure where
the structure meets all required setbacks except the common wall property line.

Based on my review of the certificate of survey, the building within the proposed
subdivision does meet the setback requirements. In addition, the proposed subdivision
meets all the requirements of Section 1104.04A of the City Code.

A letter to the applicant approving the subdivision is attached for your signature. If you
have any questions, let me know.
