<br /> <br />MEMORANDUM <br /> <br />FROM: <br /> <br />Dennis Welsch, Community Development Director <br />Kim Lee, City Planner ~ <br /> <br />DA TE: <br /> <br />September 19, 1997 <br /> <br />SUBJ: <br /> <br />Minor Subdivision of 2401 and 2403 Brenner Court (PF#2959) <br /> <br />The purpose of this memo is to provide you with an overview of the request for a minor <br />subdivision of the property located at 2401 and 2403 Brenner Court. This property is <br />located in an R-2, Two Family District, and is designated as Low Density Residential in the <br />City's Comprehensive Plan. <br /> <br />A building permit was issued for a twinhome in this location in May 1997. Plan Reviewer <br />Marty Hanson has indicated that the construction does meet Uniform Building Code <br />requirements for a zero lot line subdivision as proposed. <br /> <br />Section 1004.03D of the City Code requires a front yard setback of 30 feet, a side yard <br />setback of 10 feet, and a rear yard setback of 30 feet in an R-2 zoning district. The <br />minimum lot width, depth, and area requirements have not historically been applied to <br />common wall duplex subdivisions. <br /> <br />Section 11 04.04A of the City Code outlines the requirements for a common wall duplex <br />subdivision. This type of minor subdivision is limited to a common wall duplex minor <br />subdivision of a parcel in an R-2 District or other zoning district which allows duplexes, <br />along a common wall of the structure and common lot line of the principle structure where <br />the structure meets all required setbacks except the common wall property line. <br /> <br />Based on my review of the certificate of survey, the building within the proposed <br />subdivision does meet the setback requirements. In addition, the proposed subdivision <br />meets all the requirements of Section 1104.04A of the City Code. <br /> <br />A letter to the applicant approving the subdivision is attached for your signature.
