1004.01 F. Residence Relocations: 1. Policy: It shall be the stated policy of the City to maintain a harmonious and high standard of residential devel- opment and to protect such areas from deleterious effects through en- suring that both new and relocated dwellings from other areas, both within* the City and from outside, shall meet specified requirements. G. 2. Relocations Permitted On Condi- tion: Relocations of dwellings shall be permitted in the zoning district where all necessary specifications as to lot sizes, setbacks, type of use, height regulations and all other conditions as laid down in this Title are met. (Ord. 275, 5-12-1959) 3. Relocation Permit Required; Appli- cation: a. Relocations shall require a relo- cation permit from the City Council. The applicant shall file an application giving the legal description of the land upon which the building is to be moved, the nature of the building to be moved, together with a certified property search of property owners within two hundred fifty feet (250') of the new location and pay a fee ac- cording to Section 1014.03 of this Title. (Ord. 493, 6-20-1966) b. The applicant shall be accompa- nied by a written consent and approv- al of at least fifty percent (50%) of the property owners within two hundred fifty feet (250') of the relocation. (Ord. 275,5-12-1959; 1995 Code) c. The application shall be referred to the City Council who shall set a time and place for a public hearing. 1. The Chief Code Enforcement Officer shall provide a report to the City Council and after hearing the matter the City Council may grant or reject the Issuance of a permit. Restrictions: Permitted home occu- pations shall not be conducted in any building on the premises other than the building which is used by the oc- cupant as the private dwelling, and not more than one room may be used for such purposes.
