<br />4.0 STAFF RECOMMENDA TION <br /> <br />4.1 Based on the findings outline in Section 3.1, staff recommends approval of the <br />request for a variance to reduce the side yard setback to four feet and the rear yard <br />setback to three feet for the purpose of constructing an attached two car garage at <br />2416 Lexington Avenue N, with the following provisions: <br /> <br />1. The driveway must be hard-surfaced in conjunction with construction of the <br />garage in accordance with Section 703.04(B)(7) of the City Code <br /> <br />2. A vehicle turnaround area must be constructed in accordance with Section <br />703.04(B)(10) of the City Code, since Lexington Avenue is a County <br />roadway. If this area provides a turnaround/parking area for more than two <br />vehicles, screening from Lexington Avenue must be installed. <br /> <br />5.0 PLANNING COMMISSION ACTION <br /> <br />5.1 On December 10, 1997, the Planning Commission held a public hearing on the <br />request. Frederick Chute was present to answer questions and provide additional <br />information. A letter was received from Sami EISharif, property owner to the north, <br />opposing the construction of any garage on this property. <br /> <br />All property owners within 350 feet of the project were notified in accordance with <br />State Statute and City policy. No other residents commented at the public hearing <br />or contacted City staff regarding this reqeust. <br /> <br />5.2 The Planning Commission discussed the location of an existing fence on the north <br />side of the property and the screening provided, the age of the home, and the <br />hardships for granting a variance. <br /> <br />5.3 By a 5-0 vote, the Planning Commission recommended that the City Council grant <br />a variance to reduce the side yard setback to four feet and the rear yard setback to <br />three feet for the purpose of constructing an attached two car garage at 2416 <br />Lexington Avenue, based on the findings outlined in Section 3.1 of this report and <br />with the provisions outlined in Section 4.1 of this report. <br /> <br />6.0 SUGGESTED CITY COUNCIL ACTION <br /> <br />6.1 By resolution, grant a variance to reduce the side yard setback to four feet and the <br />rear yard setback to three feet for the purpose of constructing an attached two car <br />garage at 2416 Lexington Avenue N, based on the findings outlined in Section 3.1 <br />of this report and with the provisions outlined in Section 4.1 of this report. <br /> <br />Attachments: notification map; notice of public hearing; survey of property; proposed site plan; proposed floor plan; proposed building <br />elevation; project narrative from applicant; letter from neighbor; and resolution. <br />6Q-dayTime Limit: application submitted on November 10,1997; application accepted as complete on November 19,1997; decision <br />deadline is March 9,1998 (extended by City Council on 12/08/97). <br />Prepared by: Kim L.
