EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE * * * * * * * * * * * * * Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was duly called held at the City Hall on Monday, the 5th day of December, 1995 at 7:30 P,M. The following members were present: and the following were absent: Member introduced the following resolution and moved its adoption: RESOLUTION NO. RESOLUTION APPROVING THE PRELIMINARY SELECTION OF TO INITIATE NEGOTIATIONS ON A DEVELOPMENT AGREEMENT FOR THE ARONA DEVELOPMENT SITE. WHEREAS, the City of Roseville began a "Request for Proposals" for the Arona Development site in January, 1995, and WHEREAS, the Roseville City Council reviewed proposals from numerous development teams in an attempt to select a development proposal which best served the City's interests. NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") of the City of Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that the City Council hereby approves the preliminary selection of as the development team for the Arona Development site and hereby authorizes City staff to begin negotiations on a development agreement for the site with the following understandings: 1, Both parties enter into these negotiations willingly. 2, Ifwithin 120 days of this date, no development agreement has been approved by both parties, the City shall withdraw ITom further negotiations unless the City elects to extend the negotiation period, 3, Until approval of a development agreement by both parties, either party may at any time during th enegotiation period and for any reason withdraw ITom further negotiations without penalty or liability to the other party, 4, Upon withdrawal of either party ITom the negotiations, the City may preliminarily select another development team for the site and begin negotiations of a development agreement with the new team,
