(''F AI"). Mr. K~y J vice-president <br />ofF AI. reviewed with me receftt1y the results of an application made by FAlin ~he City ofRoscville <br />for a conditional use peanit C'CuP'j to constrUct a nCW Atby's/Sbarro restaurant on a location <br />where there already was an Alby's restautcnt and a fi"ee-standing sign related thereto. <br /> <br />I understand that the City Council approved the CUP but with a condition that the existing <br />sign be eliminated and replaced with a conforming sign. My client has objec.tr-...d to that condition. <br /> <br />The existing non-CODformiti~ relate to setback, size of sign. and overall height of sign. <br /> <br />. I have reviaaved the xecord before the City and the City ordinances and I can find no legal <br />reasons to support that condition. We ask therefore that the City Council iUnend the CUP by <br />amending 'Condition Number 6 which reads as follows; <br /> <br />"6. All signage for the project must comply with the current <br />requirements of Section 1009 of the City Code, including the size and <br />location ofwaJJ signs and directional signs." <br /> <br />1S4628DM <br />
