<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />DATE: 01/26/98 <br />ITEM NO: I-I <br />Agenda Section: <br />LAND USE <br />Franchise Associates, Inc., request for a conditional use permit to <br />allow the construction of a new Arby's/Sbarro Restaurant at 2105 <br />Snelling Avenue North (PF#2977). <br /> <br /> <br /> <br />1.0 REQUESTEDACnON <br /> <br />1.1 Franchise Associates, Inc. is requesting a conditional use permit to allow the <br />construction and operation of a new take-outlself-service restaurant (Arby's/Sbarro) <br />at 2105 Snelling Avenue North. <br /> <br />1.2 The conditional use permit process for this request allows the City to consider <br />compatibility with adjoining properties; impacts on traffic, public facilities, and <br />property values; impact on the general health, safety, and public welfare; and <br />compatibility with the City's comprehensive plan. The process also allows the City <br />to impose those conditions it considers necessary to protect the public health, <br />safety, and welfare. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Franchise Associates, Inc. holds a lease agreement for property at 2105 Snelling <br />Avenue North, which is owned by Betty and Harvey Charbonneau. The 1.04 acre <br />parcel is located in a B3, General Business District, and the Comprehensive Plan <br />designates the property as Business. Adjacent land uses include commercial to the <br />north and south, high density residential to the west, and commercial to the east <br />across Snelling Avenue North. <br /> <br />2.2 Franchise Associates invited neighboring property owners to stop by Arby's <br />between 4:00 p.m. and 6:00 p.m. on Wednesday, January 7,1998. Doug Kennedy, <br />a representative of Franchise Associates, was there to answer questions and show <br />the plans of the proposed restaurant. The invitation to adjacent property owners <br />also included Mr. Kennedy's phone number if anyone had questions and was <br />unable to attend. In speaking with Mr. Kennedy on January 8, 1998, he indicated <br />that none of the neighboring property owners stopped by to speak with him. <br /> <br />2.3 The property is currently occupied by an 3,660 square foot Arby's Restaurant on the <br />eastern portion of the site. The existing restaurant has 112 seats, 53 off-street <br />parking spaces, and a drive-through with stacking capacity. The existing restaurant, <br />which was constructed in 1972 and upgraded in 1985, has been operated by <br />Franchise Associates, Inc. since it opened in 1973.
