On January 14th, we appeared before <br />your Planning Commission to secure approval for a conditional use permit to <br />replace the existing Arby's Restaurant with a new Arby's/Sbarro facility. It is my <br />understanding you have a copy of the packet that was presented to the <br />Planning Commission regarding the details of our proposal. <br /> <br />The only item of the staff's findings in the staff report that was not approved was <br />finding #4.6 relating to signage. We proposed and staff accepted the right for <br />us to maintain our existing Arby's pylon sign. We would replace the readerboard <br />section with the Sbarro logo and not have a readerboard. In 5 meetings I've <br />had with staff dating back to March 5, 1997, I had always been assured that our <br />current pylon could remain as a non-conforming use under Section 1009.10 of <br />your city code. <br /> <br />I wanted to take the opportunity by means of this letter to share with you the <br />comments I made before the Planning Commission as to why they should have <br />accepted staff's findings in this regard. <br /> <br />Arby's is one of the pioneers in the fast food service industry in the Twin Cities <br />area. Part of our heritage and tradition is the cowboy hat sign that customers <br />have come to identify as Arby's. There are six signs like this remaining in the Twin <br />Cities. Five of these six stores have been upgraded and in every case the <br />municipality has allowed us to keep the Arby's hat sign similar to the one in <br />Roseville. I have enclosed pictures of three of the most recent redevelopments <br />where the sign has stayed.
