January 15, 1998 Council Member Dean Maschka City of Roseville 1695 Millwood Avenue Roseville, MN 55113 Dear Council Member Maschka: Our company has owned and operated the Arby's Restaurant at 2105 N. Snelling Avenue since it opened in 1973. On January 14th, we appeared before your Planning Commission to secure approval for a conditional use permit to replace the existing Arby's Restaurant with a new Arby's/Sbarro facility. It is my understanding you have a copy of the packet that was presented to the Planning Commission regarding the details of our proposal. The only item of the staff's findings in the staff report that was not approved was finding #4.6 relating to signage. We proposed and staff accepted the right for us to maintain our existing Arby's pylon sign. We would replace the readerboard section with the Sbarro logo and not have a readerboard. In 5 meetings I've had with staff dating back to March 5, 1997, I had always been assured that our current pylon could remain as a non-conforming use under Section 1009.10 of your city code. I wanted to take the opportunity by means of this letter to share with you the comments I made before the Planning Commission as to why they should have accepted staff's findings in this regard. Arby's is one of the pioneers in the fast food service industry in the Twin Cities area. Part of our heritage and tradition is the cowboy hat sign that customers have come to identify as Arby's. There are six signs like this remaining in the Twin Cities. Five of these six stores have been upgraded and in every case the municipality has allowed us to keep the Arby's hat sign similar to the one in Roseville. I have enclosed pictures of three of the most recent redevelopments where the sign has stayed.
