<br />3. Final grading and utility plans must be reviewed and approved by the Public <br />Works Director. An erosion control plan must be developed and erosion <br />control must be in place prior to grading of the site. Since the site is less <br />than 2.5 acres in size, it is unlikely that on-site ponding will be required by <br />the Rice Creek Watershed District; however, the applicant will need to <br />contact the District for permit requirements. <br /> <br />4. All site lighting, including lighting for the parking area and exterior building <br />lighting, must comply with the requirements of Section 1010.12 of the City <br />Code. A lighting plan must be submitted to and approved by the City in <br />conjunction with application for a building permit. <br /> <br />5. A detached trash enclosure will be allowed, provided it is constructed of the <br />same or similar masonry materials as the principal structure and roofed in <br />accordance with Section 1010.14 of the City Code. <br /> <br />6. The existing non-conforming pylon sign for Arby's will be allowed to remain, <br />with the face of the reader board portion being replaced to allow pylon <br />signage for Sbarro. All other signage for the project must comply with the <br />requirements of Section 1009 of the City Code, including the size and <br />location of wall signs and directional signs. <br /> <br />7. The sidewalk along the front of the property shall be improved and/or <br />replaced if required by the City in conjunction with site development. <br />Pedestrian access must be provided from this sidewalk to the front door of <br />the building via a paved pedestrian surface. <br /> <br />8. Prior to a building permit being issued for redevelopment of the site, the <br />applicant shall post a landscape bond, letter of credit, or other security <br />acceptable to the City, in an amount equal to 150% of the cost of site <br />landscaping, street tree planting, and site restoration. The specific amount <br />of this security shall be determined by the Community Development Director <br />following completion of all site construction plans. <br /> <br />9. The water and sewer lines for the existing building must be disconnected <br />upon completion of the new building and demolition of the existing building. <br /> <br />10. The applicant shall record the approved conditional use permit with the <br />Ramsey County Recorder prior to the issuance of any building permit or <br />within sixty days of approval, whichever is less (Section 1013.01 G of the City <br />Code). <br /> <br />11. The conditional use permit shall expire within six months of the date of City <br />Council approval if a building permit is not obtained for the approved <br />development (Section 1013.03 of the City Code). <br /> <br />PF#2977 - RPCA (01/14/98) - Page 5 of 6 <br />
