Box 130190
Roseville, MN 55113

RE: City of Roseville and Everest
Our File No: 1011.162

Dear Mr. Nelson:

Steve Sarkozy has asked me to respond to your November 26, 1997, [etter to him. I
have also had a voicemail communication from your attorney, George Ludke, asking to set up
a meeting to discuss this matter. I have returned the call and have proposed that a meeting be
scheduled next week with you, Mr. Ludke, Steve Sarkozy and myself. I have not heard back
from him yet.

With regard to your letter, I have made inquiries of the Community Development
Department and they advised me that a notice of the work session was sent by US Mail to you
on Friday, November 14,1997, and that a fax was sent to your office on that same day.

I asked Dennis Welsch why he did not remind you of the meeting when he called you
on Monday, during the day, and he stated that he was calling you regarding the appHcation for
comprehensive plan amendment which had previously been submitted by you, and it did not
occur to him to remind you of the meeting. He assumed that you would be there.

I can tell you from my own experience that I was asked to be at that meeting because
they believed that you would be there to present the proposal to the City Council on an informal
basis, as is their practice at work sessions.

Your suggestion that you were set-up by the City staff is not born out by the evidence.
Vou received no different notice of the meeting than anyone else did. It is unfortunate that you
did not see the fax or the letter in time to attend the meeting.

· Also Admitted in Wisconsin
tCivil Trial Specialist.
