B <br />REQUESTED ACTION --::- tt:cJ~ltw,\ t'UAA ~ "3~ <br /> <br /> <br /> <br />1.1 <br /> <br />Everest Development, ltd. has informed the City that it is withdrawing its application <br />to amend the City's Comprehensive Plan to change the designation of seven <br />parcels of land from Medium Density Residential to Limited Business. <br /> <br />1.2 <br /> <br />It is the policy of the City to take official action to accept the withdrawal of an <br />application for any land use action, including amendments to the City <br />Comprehensive Plan. It is also the policy of the City to apply the provisions of <br />rehearing as outlined in Section 1015.05 of the City Code to requests for <br />Comprehensive Plan amendments. Section 1015.05 of the City Code states, "No <br />person shall be entitled to present any petition for the rezoning of land within six (6) <br />months from the receipt of a petition seeking substantiaily the same rezoning where <br />such original petition has been enacted upon and denied. This provision shall not <br />affect any riQht to present a petition where a former ~etitjon has been withdrawn. <br />(Ord. 289,3-22-1960)" <br /> <br />BACKGROUND <br /> <br />Everest Development, Ltd, on behalf of its affiliate, Hamline Avenue Properties, <br />LlC, requested an amendment to the City Comprehensive Plan to change the land <br />use designation of seven parcels of land from Medium Density Residential (MR) to <br />Limited Business (LB), <br /> <br />The Planning Commission held a public hearing on this request on January 14, <br />1998, and adopted a recommendation that the request be denied. <br /> <br />In a letter dated January 16, 1998, Everest Development, ltd., informed the City <br />that it was withdrawing its application and stated that the application should be <br />removed from the January 26, 1998, City Council meeting. <br /> <br />SUGGESTED CITY COUNCIL ACTION <br /> <br />By resolution, accept the withdrawal of Everest Development's application for a <br />comprehensive plan amendment. <br /> <br />Attachments: letter from Everest Development, ltd and resolution. <br /> <br />M:\RCA\PF2978 <br />
