<br />" <br /> <br />. <br /> <br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 2/23/98 <br /> <br />ITEM NO.: J-l <br /> <br />Department Approval: <br /> <br />\R, <br /> <br />Manager Reviewed: <br /> <br />Agenda Section: <br /> <br />~ <br /> <br />Item Description: Right-of-Way Management Ordinance <br /> <br />Background: At the September and November work sessions, the Council reviewed a model <br />right-of-way ordinance prepared by the League of Minnesota Cities which confonns to recent <br />federal and state legislation. The current draft of the ordinance was read by the Council on <br />December 8, 1997 and January 26, 1998. <br /> <br />The Minnesota legislature required that the Minnesota Public Utilities Commission (MPUC) <br />adopt rules to standardize many of the aspects of right -of-way management. The current draft of <br />the ordinance is based on a model prepared by the League of Minnesota Cities. Recently, as a <br />result of work with the MPUC rule making process, the League of Minnesota Cities has issued a <br />new draft of the right-of-way ordinance which is significantly different than the one which our <br />proposed ordinance is based. The new model ordinance is more closely aligned with expected <br />MPUC rules. The new model ordinance is currently being reviewed by the City Attorney's office <br />and has not been revised for the City of Roseville. <br /> <br />In order to allow adequate time for legal review, it is recommended that the Council continue the <br />final adoption of this ordinance to the March 10, 1998 City Council meeting. <br /> <br />RECOMMENDED COUNCIL ACTION: <br /> <br />Motion continuing the adoption of a new right-of way management ordinance to March 10, 1998. <br /> <br />Prepared by: Karl P.
