City Of Roseville Planned Unit Development Agreement # Draft for Review: Feb 1, 1999 based on meeting with Jim and Deb Schreier Jan. 7, 1 999 and Jan.26, 1999. AGREEMENT, dated February 8, 1999, between the City of Roseville, a Minnesota municipal corporation (herein referred to as "CITY"), and Charles Cabinet Company Incorporated, a Minnesota Corporation (herein referred to as "DEVELOPER"). 1.0 Effective Date of Agreement This agreement shall be effective upon completion of the following: 1) passage and publication of Ordinance #_ (Rezoning of Property to PUD); 2) publication of the ordinance in the CITY's official newspaper; 3) execution of this agreement by the CITY and the DEVELOPER; and 4) recording ofthis agreement with Ramsey County. 2.0 Request for Planned Unit Development and Plat Approval The DEVELOPER has asked the CITY to approve a Planned Unit Development (PUD) (PF#2986) consisting of a 10,000 square foot (approximate) office/showroom/cabinet manufacturing business on the southern parcel, a single family owner-occupied house on the northern parcel, and a single family rental house on the northern parcel. The subject property is located at 3090 Cleveland A venue North, and is legally described as follows: Lots 4-6, Block I, Rochat's Addition to the City of Roseville, Ramsey County, Minnesota (PIDs 042923220008 and 042923220011). PARCEL A: The northern parcel is described as all of Lot 4, and Lot 5 except the South 36 feet thereof and also except the North 9.5 feet of the South 45.5 feet of the East 21 feet of the West 101 feet thereof, Block 1, Rochat's Addition to the City of Roseville, Ramsey County, Minnesota (PID 042923220008). PARCEL B: The southern parcel is described as the South 36 feet of Lot 5, the North 9.5 feet of the South 45.5 feet ofthe East 21 feet of the West 101 feet of Lot 5, and all of Lot 6, Block I, Rochat's Addition to the City of Roseville, Ramsey County, Minnesota (PID 042923220011). 3,0 Planned Unit Development and Plat Approval The CITY hereby grants approval of the final development plan for Charles Cabinet Planned Unit Development, subject to the DEVELOPER's compliance with the terms and conditions of this agreement. The CITY agrees to approve applications for building pennits, provided that said plans are consistent with the exhibits which were approved at the concept and final stage of the Planned Unit Development process (located in Appendix A), the DEVELOPER has not defaulted, and all of the standards and conditions of this agreement have been satisfied.
