<br />For three (3) years from the date of this Agreement.. no amendments to the CITY'S Comprehensive <br />Guide Plan or official controls shall apply to or affect the use, development density, site layout, or <br />dedication requirements of the land included within the Planned Unit Development unless <br />required by state or federal law or agreed to in writing by the CITY and the DEVELOPER. For any <br />improvements proposed thereafter, notwithstanding anything in this Agreement to the contrary, <br />the CITY may require compliance with any amendments to the City's Comprehensive Guide Plan, <br />official controls, platting or dedication requirements enacted after the date of this Contract. <br /> <br />4.0 Approval by the CITY <br /> <br />In approving the final development plan for the PUD for Charles Cabinet, the CITY hereby <br />incorporates the following exhibits. The DEVELOPER shall develop the subject property as <br />described or shown in these exhibits. If the exhibits vary from the written terms of this <br />Agreement, the written terms shall control. The exhibits marked as approved by the City Council <br />on January 25,1998, or as amended thereafter, shall include: <br /> <br />A. Certificate of Survey <br />B. Site Development Plan (final plan not yet submitted by applicant) <br />C. Landscape Plan (final plan not yet submitted by applicant) <br />D. Preliminary Grading and Utility Plan <br />E. Building Elevations - Charles Cabinet (final not yet submitted by applicant) <br />F. Development Schedule (not yet submitted by applicant) <br /> <br />5.0 Rezoning <br /> <br />The CITY conducted hearings and meetings on February 11, 1998 (Planning Commission - sketch <br />plan review), July 8, 1998 (Planning Commission - sketch plan review), September 9, 1998 <br />(Planning Commission - hearing on concept development plan), October 14, 1998 (Planning <br />Commission - continued hearing concept development plan), October 26,1998 (City Council- <br />meeting on concept development plan), January 25, 1999 (City Council - action on final <br />development plan) to consider various aspects of the Planned Unit Development, including <br />rezoning of the subject property from R-l Single Family Residential to PUD Planned Unit <br />Development. The CITY agrees to rezone the subject property to PUD, subject to the <br />DEVELOPER's strict compliance with the approved plans, and the terms and conditions of this <br />agreement. Minor variations from the approved final development plans, which are consistent <br />with this agreement and the underlying Bl zoning district, may be approved by the CITY's <br />Development Review Committee, under the direction of the Community Development Director. <br />Substantial departures from the approved final development plans will require an amendment to <br />the Planned Unit Development in accordance with Section 1015 of the Roseville Zoning <br />Ordinance. Where not superseded by more restrictive requirements of this PUD, the standards <br />of the underlying Bl (Limited Business) zoning district shall apply, as stated in Chapter 1005 of <br />the Roseville City Code. <br /> <br />PUD Agreement # _ (Charles Cabinet) - Page 20f9 <br />
