Dennis Welsch City of Rose vi lie January 15,1999 Page 2 The CITY agrees that it will not assess parcel A or parcel B for sidewalk improvements in the event such improvements are ultimately completed by or on behalf of the CITY, for which costs special assessments are levied or assessed against the property owners for said improvements. 4, With res-pect to paragraph 9,11: It is my understanding that the proposed off-streef parking as will be shown on the site development plan will satisfy the City insofar as Charles Cabinet Company's present parking needs are concerned, In order to clarify the City's position with respect to a successor's use of the property, or our client's ovm use which might require additional parking, please add the following to the end of this paragraph: So long as the DEVELOPER maintains its use of the property as contemplated in this Agreement, the off-street parking areas constructed in accordance with the approved site development plan (Exhibit B) shall be satisfactory to the CITY. If additional parking is needed as a result of expanded use of the property by the DEVELOPER or required as a result of a successor's business activities, DEVELOPER shall have the right to satisfy the CITY's then-current parking requirements by replacing the smaller, single family residences (referenced in paragraph 9.3) with appropriate hard surface, concrete perimeter-curbed and drained parking area, or by providing the same on a parcel or parcels adjoining the subject property. Finally, I understand that the legal will be revised with regard to the north line to accommodate the present encroachment by Schreier's neighbor's house, Thank you for your consideration of this matters.
