<br />'... <br /> <br />.' <br /> <br />Dennis Welsch <br />City of Rose vi lie <br />January 15,1999 <br />Page 2 <br /> <br />The CITY agrees that it will not assess parcel A or parcel B for sidewalk <br />improvements in the event such improvements are ultimately completed by or <br />on behalf of the CITY, for which costs special assessments are levied or <br />assessed against the property owners for said improvements. <br /> <br />4, With res-pect to paragraph 9,11: It is my understanding that the proposed off-streef parking <br />as will be shown on the site development plan will satisfy the City insofar as Charles Cabinet Company's <br />present parking needs are concerned, In order to clarify the City's position with respect to a successor's use <br />of the property, or our client's ovm use which might require additional parking, please add the following to <br />the end of this paragraph: <br /> <br />So long as the DEVELOPER maintains its use of the property as contemplated <br />in this Agreement, the off-street parking areas constructed in accordance with <br />the approved site development plan (Exhibit B) shall be satisfactory to the <br />CITY. If additional parking is needed as a result of expanded use of the <br />property by the DEVELOPER or required as a result of a successor's business <br />activities, DEVELOPER shall have the right to satisfy the CITY's then-current <br />parking requirements by replacing the smaller, single family residences <br />(referenced in paragraph 9.3) with appropriate hard surface, concrete <br />perimeter-curbed and drained parking area, or by providing the same on a <br />parcel or parcels adjoining the subject property. <br /> <br />Finally, I understand that the legal will be revised with regard to the north line to accommodate the present <br />encroachment by Schreier's neighbor's house, <br /> <br />Thank you for your consideration of this matters.
