<br />.:;, <br /> <br />3.2 <br /> <br />. <br /> <br />~\~~tu~. <br /> <br />A~the Planning Commission hearing, staffhas met with the School District to <br />discuss the proposed vacation. The School District is concerned about the potential <br />access to the School at Dellwood Street. We agree that a positive solution to the issue <br />would accomplish the following: <br /> <br />1. Retain driveway access to the School on the west side of their property. <br /> <br />2. Relieve the City of ongoing maintenance costs related to maintaining this <br />driveway. <br /> <br />To this end, a number of alternatives exist including: <br /> <br />1. Vacate the right-of-way as proposed and file access easements in favor of both the <br />School and Grace Church to guarantee future use and clarify maintenance <br />responsibilities. If requested, the City could improve the pavement on behalf of <br />the School and Church and provide project financing through assessments. <br /> <br />2. Vacate the right-of-way as proposed adding 33 feet to both the School and Church <br />properties. The School could then construct a driveway within the new 33 feet. If <br />required, the City could construct the improvements and assess the costs to the <br />School. <br /> <br />3. Not vacate the right-of-way, but enter into an agreement with the School and/or <br />church to cover construction costs, maintenance costs and liability. <br /> <br />4.1 While acceptable solutions have been discussed with the School District, this issue has <br />not been discussed with Grace Church since last fall. In order to allow time to finalize a <br />solution acceptable to all parties, staff recommends continuing action on this item to the <br />June 8, 1998 meeting. <br />
