<br />EXTRACT OF MINUTES OF MEETING <br />OF CITY COUNCIL <br />CITY OF ROSEVrLLE <br />RAMSEY COUNTY, MINNESOTA <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br />of Roseville, County of Ramsey, Minnesota, was duly held in the City Hall at 2660 Civic <br />Center Drive, Roseville, Minnesota, on Monday, the 27th day of April, 1998, at 6:30 p.m. <br /> <br />The following members were present: -- and the following were absent: ----. <br /> <br />Member _ introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. <br />A RESOLUTION RELEASING PONDING EASEMENT NO.4 <br />GRANTED TO THE CITY OF ROSEVILLE BY THE COMTEN, INC. <br />BY DOCUMENT NO. 2054648 <br /> <br />WHEREAS, Sterling Roseville, LLC has requested the City to release a duplicate <br />easement granted for collection, storage, and ponding of waters over and upon Lot 3, <br />Block 1, Venture Addition (2700 Snelling Avenue North - former Comten/NCR building); <br />and <br /> <br />WHEREAS, the City Council considered the request and made the following <br />findings: <br /> <br />1. The building located at 2700 Snelling Avenue encroaches into the ponding <br />easement granted by Document No. 2054648. <br /> <br />2. The ponding easement granted to the City by Document No. 2074653 was <br />intended as a replacement easement for the ponding easement granted by <br />Document No. 2054648; however, the ponding easement granted by <br />Document No. 2054648 was never officially released by the City. <br /> <br />3. Releasing the ponding easement granted by Document No. 2054648 will not <br />have an adverse impact on the general public health, safety and welfare. <br /> <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Roseville, Minnesota, hereby releases the easement granted for collection, storage, and <br />ponding of waters over and upon Lot 3, Block 1, Venture Addition, and recorded as <br />Document No. 2054648 attached hereto. <br /> <br />Resolution _ - Page 1 of 2 <br />
