<br />This office represents Sterling Roseville, LLC, a Delaware limited liability
<br />company, the owner of the captioned property.
<br />
<br />The purpose of this letter is to request that the City of Roseville vacate that certain
<br />Ponding Easement No.4 (the "Easement"), dated July 20, 1979, made by Comten,
<br />Inc., to the City of Roseville, recorded September 11, 1979, as Document No.
<br />2054648, Ramsey County Records, copy enclosed. The Easement is encroached
<br />upon by the improvements located on the Property, as is shown on enclosed survey.
<br />It is our belief that Ponding Easement No.4 (revised 1117/79) (the "Replacement
<br />Easement"), dated December 27, 1979, made by Comten, Inc., to the City of
<br />Roseville, recorded March 24, 1980, as Document No. 2074653, copy enclosed,
<br />was given to the City of Roseville in lieu of the Easement, and that it was the
<br />intention of the parties to the Easement and Replacement Easement that the
<br />Easement be tenninated upon entry into the Replacement Easement.
<br />
<br />Therefore, please present this request for vacation to City Council at your earliest
<br />opportunity .
