REQUESTED ACTION <br /> <br />1.1 Sterling Minnesota, LLC, is requesting the release of a duplicate easement granted <br />for collection, storage, and ponding of waters over and upon Lot 3, Block 1, Venture <br />Addition (2700 Snelling Avenue North - former Comten/NCR building). <br /> <br />~ BACKGROUND <br /> <br />2.1 Sterling Minnesota, LLC recently acquired the former NCR building at 2700 Snelling <br />Avenue North. This property is located in a B1 Limited Business zoning district and <br />will be used for a multi-tenant office facility. <br /> <br />2.2 A ponding easement (Ponding Easement No.4) was granted to the City of Roseville <br />by Comten, Inc. in July 1979 (recorded in September 1979 as Document No. <br />2054648). As a portion of the building was constructed on this easement, it appears <br />that a second replacement easement was granted to the City by Comten in <br />December 1979 (recorded in March 1980 as Document No. 2074653), with the <br />understanding that the first easement would be released. <br /> <br />2.3 While researching the title for this proposed acquisition, it was discovered that the <br />original easement had never been released by the City. In order to remove the <br />encroachment of the building into the original ponding easement, Sterling Minnesota, <br />LLC is now requesting that the original easement be officially released. <br /> <br />2.4 Since this is a utility easement granted to the City by separate document rather than <br />through dedication on a plat, it can be released by the City. No hearings or <br />notification of adjacent property owners is required. <br /> <br />3d] STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff has made the following findings: <br /> <br />1. The building located at 2700 Snelling Avenue encroaches into the ponding <br />easement granted by Document No. 2054648. <br /> <br />2. The ponding easement granted to the City by Document No. 2074653 was <br />intended as a replacement easement for the ponding easement granted by <br /> <br />PF3002 - RCA (04/27/98) - Page 1 of 2 <br />
