<br />., <br /> <br />2.2 Staff has interpreted the Council direction to mean "one major accessory building", <br />Le., one detached garage in the rear yard. The size ofthe major accessory building <br />and any shed for garden tools must not exceed 25% of the reauired rear yard. <br /> <br />2.3 Staff has interpreted the Code and the Council direction in this manner for the <br />following reasons: <br /> <br />A. It sets a maximum impervious surface allowed on each residential lot <br />(buildings, patios, and driveways) and reduces some drainage issues. <br />B. It reduces the extraneous storage such as trucks, extra boats, etc., and <br />reduces the demand to turn such buildings into job shops. <br />C. It reduces multiple building walls in the rear yards, allowing for some physical <br />and visual green space and movement of air. <br /> <br />3.0 SUMMARY OF ALTERNATIVE INTERPRETATIONS <br /> <br />3.1 The Required Yard YS. Rear Yard Interpretation <br /> <br />A. Staff: Interpret the Code requirements to allow for the size of accessory <br />buildings to be no more than 25% of the required rear yard area. <br />B. Mr. Heffernan: Interpret the Code requirements to allow for the size of <br />accessory buildings to be 25% of the total rear yard. <br /> <br />3.2 The Building Size and/or Building Number Interpretation <br /> <br />A. Staff: Interpret the Code to read "an accessory building" shall not occupy <br />more than 25% of the required rear yard. (Staff interprets this as one major <br />and one minor - garden shed - accessory building). <br />B. Mr. Heffernan: Interpret the Code to read - any number of accessory <br />buildings are acceptable as long as they do not exceed a size, in total, of <br />more than 25% of the required rear yard. <br /> <br />3.3 After discussion, direct that this issue be sent to a future work session. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />Staff recommends continued interpretation of the Code as per 3.1 (A) and 3.2(A) <br />and at a future date amend the Code to include similar language. <br /> <br />5.0 SUGGESTED ACTION <br /> <br />By motion, interpret the Code as described in Sections 3.1 (A) and 3.2(A) above and <br />at a future date amend the Code to include similar language. <br /> <br />Attachments: Heffernan letter 4/20; City Code 1002,02, 1004.01 <br />M:\RCA\PF3012 <br /> <br />PF#3012- RCA (04/27/98) - Page 2 of 2 <br />
