<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />DATE: 08/10/98 <br />ITEM NO: <br />Manager Approval: Agenda Section: <br />LAND USE <br />IC ae e ernan reques or a variance 0 a ow a secon e ac e <br />garage at 2042-2044 Dale Street North (PF 3021). <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Based on Council direction and agreement from the applicant, at the July 27, 1998 <br />Council meeting, Michael Heffernan has changed his request for a variance to allow <br />the construction of a second accessory building and a variance to increase the lot <br />coverage to 37.6% of the required rear yard for the purpose of constructing a 24' x <br />36' (864 s.f.) detached garage at 2042-2044 Dale Street North. <br /> <br />Requirement <br /> <br />Proposal <br /> <br />Variance <br /> <br />An accessory building <br /> <br />2nd accessory building <br /> <br />One additional building <br /> <br />Lot Coverage - 25% of <br />required rear yard <br />(574 square feet) <br /> <br />70% coverage <br />(864 square feet) <br />and 748 s.f. existing) <br /> <br />45% variance <br />(1038 square feet) <br /> <br />1.2 The City Council upheld staff's interpretation of these requirements during an <br />administrative appeal of the interpretation by Mr. Heffernan; however, the City <br />Council did provide Mr. Heffernan with the opportunity to go through the minor <br />variance procedure for this request. The Minor Variance Committee denied the <br />request, and Mr. Heffernan has decided to apply for a variance through the regular <br />variance procedure. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Michael Heffernan owns a two family dwelling at 2042-2044 Dale Street North. The <br />property is located in an R-2 Single Family Residential District, and the <br />Comprehensive Plan identifies this property as Low Density Residential. Adjacent <br />land uses include low density residential to the north. south, east, and west. <br /> <br />2.2 Mr. Heffernan is now (8/10/98) requesting a variance from Section 1004.01 of the <br />City Code, to allow the construction of a second accessory building and to increase <br />the lot coverage to 70% of the required rear yard. Mr. Heffernan's lot is 76.5' x 267' <br />(20,426 square feet) and is occupied by a duplex and an existing detached garage. <br />In order to provide vehicle storage and yard equipment storage for both dwelling <br /> <br />RCA (PF 3021) - 07127/98 - Page 1 of 4 <br />
