<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 04/27/98 <br />ITEM NO: 1-4 <br />~~~ent Approval: Manager Approved: Agenda Section: <br />~ ~ LAND USE <br />Item Description: Randall Dyson request for a minor variance at 2474 Churchill Street <br />PF#3016) <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Randall Dyson is requesting a minor variance to allow continued use of an existing <br />gravel boulevard parking space (parking on the right-of-way between the curb and <br />the property line) at 2474 Churchill Street. <br /> <br />Drivewav Reauirement <br />Side yard setback - 51 <br />Entirely on private property <br /> <br />ProDosal <br />0' setback <br />on R.O.W. <br /> <br />Variance <br />Public property <br />none available <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Randall Dyson owns a single family residence at 2474 Churchill Street. The <br />property is located in an R-1 Single Family Residential District, and the <br />Comprehensive Plan identifies this property as Low Density Residential. Adjacent <br />land uses include single family residential to the north, south, east, and west. <br /> <br />2.2 Mr. Dysan is requesting a minor variance from Section 1004.01 D which requires 2 <br />parking spaces per single family detached lot and Section 703.04 of the City Code <br />which requires driveways and parking on private property to be paved and set back <br />5 feet from the side property line. <br /> <br />2.3 Mr. Dysan states that the gravel space adjacent to his driveway at the edge of the <br />right-of-way helps avoid street parking for a second vehicle. In addition if required <br />to move the parking 20 feet into his property, Mr. Dysan would have to cut down a <br />28 foot coniferous tree. <br /> <br />2.4 The City Code does not allow for private parking spaces on the boulevards. No <br />variances are possible for use of the public right-of-way. Mr. Dysan's options are <br />limited to expanding his driveway by removing the conifer, realigning the driveway <br />adjacent to the entry steps up to the house, or expanding the north parking line. <br /> <br />2.5 This request has been processed as a minor variance request; the applicants were <br />able to obtain the written consent of the adjacent property owner. <br /> <br />2.6 Section 1013.02 outlines the criteria and procedure for considering a variance. <br /> <br />PF#3016 - RCA (04/27/98) - Page 1 of 2 <br />
