1. The boulevard parking space is listed on the inventory of boulevard parking
spaces regularly in use, dated June 30, 1984.

2. A public improvement project being undertaken in 1998 (Project 98-02) will
involve the disturbance of the boulevard at 2474 Churchill Street.

3. A 28 foot coniferous tree and a two foot retaining wall would need to be
removed in order to extend the boulevard parking space the required 20 feet
onto the property.

4. There is no other practical location or alternative for an off-street parking
area on the property. The topography of the parcel does limit options for
relocating the driveway to the south side of the parcel without moving the
driveway retaining wall and the entry steps.

5. The proposed use, investing in the existing housing stock and making it more
livable, is in harmony with the general purpose and intent of the City's
Comprehensive Plan and Title 10 of the City Code (Zoning).

6. As discussed in the past cases, the proposed variance allowing vehicles to
park on the boulevard, and, if granted, could adversely affect the public
health, safety, or general welfare (especially drivers view of adjoining, but
visually screened driveways, and snow plowing ). However, in this case, the
vehicle would be entirely off the road surface and parked into an existing
berm - because of this berm, the parking does not further hinder a drivers
view.

4.0 SUGGESTED CITY COUNCIL ACTION

5.1 By motion, approve of Randall Dyson's request for a minor variance to allow the
continuance of a boulevard parking space at 2474 Churchill Street North, based on
the findings of the Minor Variance Committee outlined in Section 3.2 of this report.

Attachments: location map; minor variance application; written statement from applicant; written consent of
adjacent property owners; sketch of boulevard parking space; photograph of property.

60-day Time limit application submitted on April 20, 1998; decision deadline is June 19,1998.

Prepared by: Dennis Welsch (490-2232) and Kim Lee (490-2236)
M:\RCA\PF3016B.RCA

PF#3016b - RCA (05/26/98) - Page 3 of 3
