'-~

requiring the applicant to bring the parking area into compliance with setback
requirements will result in a loss of parking spaces. (See attached memo from Jay
Kennedy, 7/27/98.)

2.7 In November 1990, Suburban True Value Hardware was granted a conditional use
permit to allow the exterior display of merchandise with the following conditions:

1. That the hours of outside display and the type of equipment displayed by as
described in the applicant's letter of September 14, 1990. (Lawnmowers and
similar merchandise to be displayed Monday - Friday from 8:00am to
8:00pm, Saturday from 8:00am to 5:00pm, and Sunday from 11 :OOam to
4:00pm.)

2. That the storage occurs as shown on the plans dated September 14, 1990.
(Merchandise to be displayed on the sidewalk area on the front (west) side
of the building, in a five foot wide area adjacent to the building)

3. That the heights of the displays not exceed five feet.

2.8 Merchandise such as lawn mowers and power tools is rented from this location.
Other than the exterior storage allowed by the conditional use permit issued in
1990, there will be. no additional outdoor storage of merchandise for rent. . Mr.
Johnson has indicated that he has no intention of expanding his rental business to
include larger items, such as trailers or other vehicles.

2.9 Suburban True Value Hardware repairs lawnmowers and similar equipment.
Because of limited interior space, equipment awaiting repair is often stored on the
south side of the building. Mr. Johnson has been informed that this is a violation at
the City Code and needs to be addressed.

2.10 Concerns were also expressed regarding drainage of the property. The parking lot
sheet drains to Lexington Avenue, which was approved by the Public Works
Director in 1989. Building drainage will have to be directed to the front of the
building, rather than diverted on to adjacent properties. Because of the additional
impervious surface, storm water detention will need to be provided on-site so that
the run-off rate in a 10-year storm event does not exceed'the current run-off rate.
(See attached memo from Jay Kennedy, 7/27/98.)

2.11 The Ramsey County Master Street Plan identifies Lexington Avenue as a future 99
foot right-ofpway. An additional 16.5 feet of right-at-way will be required along the
western edge of this parcel. It has not been the policy of the City to require
dedication of additional right-of-way as a condition of variance approval.

2.12 The corner of Lexington Avenue and Roselawn Avenue has been identified as a
Cornerstone intersection and concepts for redevelopment of this corner have been

PF#3029 - RCA (08/24/98) - Page 3 of 8
