<br />5.0 PLANNING COMMISSION ACTION <br /> <br />5.1 At the hearing held on August 12, 1998 the Planning Commission recommended <br />approval of a variance to reduce the rear yard (east) setback to 3 feet and the side <br />yard (north) setback to 4.5 feet for the purpose of constructing an addition to an <br />existing building (within established building lines) at 1930 Lexington Avenue North, <br />based on the findings outlined in Section 3.1 of this report and with the provisions <br />outlined in Section 4.1 of this report. <br /> <br />5.2 At the same hearing, the Planning Commission recommended denial of a variance <br />to reduce the front yard setback of a pylon sign to five feet for the purpose of <br />replacing an existing pylon sign at 1930 Lexington Avenue North, based on the <br />findings outlined in Section 3.2 of this report. The Commission recommended an <br />alternative as listed in 5.3. <br /> <br />5.3 The Commission also recommend approval of a variance to reduce the front yard <br />setback of a pylon sign to 15 feet for the purpose of replacing an existing pylon sign <br />at 1930 Lexington Avenue North, based on the findings outlined in Section 3.2 of <br />this report and with the provisions outlined in Section 4.2 of this report. <br /> <br />5.4 The Planning Commission's draft minutes concerning the project are attached. <br /> <br />6.0 SUGGESTED COUNCIL ACTION <br /> <br />6.1 By motion, approve of a variance, subject to additional improvements to be <br />completed in one year, to reduce the rear yard (east) setback to 3 feet and the side <br />yard (north) setback to 4.5 feet for the purpose of constructing an addition to an <br />existing building (within established building lines) at 1930 Lexington Avenue North, <br />based on the findings outlined in Section 3.1 of this report and with the provisionDs (""'i' <br />outlined in Section 4.1 of this report. The additional improvements must include <br />boulevard landscaping and sidewalks, parking lot improvements, curb and gutter, <br />trash enclosure and landscaping to the south of the property and must b <br />completed prior to receiving a certificate of completion. <br /> <br />It is understood from written communications in the packet that the applicant WiII\ V <br />comply with the landscaping and screening plans per the Bachman plan agreed to <br />by the Townhome Association and will also comply with the drainage/storm sewer <br />corrections recommended by City Engineering. <br /> <br />In addition, the applicant has agreed to work with the City in completing the <br />additional improvements for boulevard landscaping, parking lot improvements, curb <br />and gutter, trash enclosures and additional landscaping to the south of the property. <br /> <br />PF#3029 - RCA (08/24/98) - Page 7 of 8 <br />
