REQUEST FOR PLANNING COMMISSION ACTION

DATE: 07/08/98
ITEM NO: 6(b)
art nt Approval: Agenda Section:
t(.L, PUBLIC HEARINGS
David Johnson (Suburban True Value Hardware) request for setback
variances for a building addition and a replacement pylon sign at
1930 Lexington Avenue North (PF#3029)

1.0 REQUESTED ACTION

1.1 David Johnson is requesting a variance to reduce the rear yard (east) setback to
3 feet and the side yard (north) setback to 4.5 feet for the purpose of constructing
an addition to an existing building (within established building lines) and a variance
to reduce the setback of a pylon sign to 5 feet for the purpose of replacing an
existing pylon sign at 1930 Lexington Avenue North.

Requirement

Proposal

Variance

Rear yard setback - 20'
Side yard setback - 10'

3' setback
4.5' setback

17' variance
15.5' variance

Sign front yard setback - 30'

5' setback

25' variance

2.0 BACKGROUND

2.1 David Johnson holds a purchase agreement for the property, which is owned by
Robert and Martha Houck and occupied by Suburban True Value Hardware. The
property is located in a B-2 Retail Business District, and the Comprehensive Plan
identifies this property as Business. Adjacent land uses include a townhome
development to the east and commercial uses to the north, south, and west.

2.2 Mr. Johnson is requesting a variance from Section 1005.01 (A) of the City Code to
reduce the rear yard setback to 3 feet and the side yard setback to 4.5 feet for the
purpose of constructing a 75' x 25' (1,875 square feet) addition to an existing 4,625
square foot building (6,500 square feet total with addition). The addition will be
constructed within established building lines. The existing building is an L-shape
building, which is classified as a non-conforming structure because it does not meet
the required setbacks. A 25 foot portion of the building is three feet from the rear
(east) property line and a 46 foot portion is approximately five feet from the side
(north) property line. The proposed addition would square off the northeast corner
of the building and would not encroach into these established setback line. The
building will include approximately 1,000 square feet of shop space and 5,000
square feet of retail space.

PF#3029 - RPCA (07/08/98) - Page 1 of6
