2. That the storage occur as shown on the plans dated September 14, 1990.
(Merchandise to be displayed on the sidewalk area on the front (west) side
of the building, in a five foot wide area adjacent to the building)

3. That the height of the displays not exceed five feet.

2.8 Merchandise such as lawnmowers and power tools are rented from this location.
Other than the exterior storage allowed by the conditional use permit issued in
1990, there will be no additional outdoor storage of merchandise for rent. Mr.
Johnson has indicated that he has no intention of expanding his rental business to
include larger items, such as trailers or other vehicles.

2.9 Suburban True Value Hardware repairs lawnmowers and similar equipment.
Because of limited interior space, equipment awaiting repair is often stored on the
south side of the building. Mr. Johnson has been informed that this is a violation
of the City Code and needs to be addressed.

2.10 Concerns were also expressed regarding drainage of the property. The parking lot
sheet drains to Lexington Avenue, which was approved by the Public Works
Director in 1989. Building drainage will have to be directed to the front of the
building, rather than diverted on to adjacent properties. Because of the additional
impervious surface, storm water detention will need to be provided on-site so that
the run-off rate in a 1 O-year storm event does not exceed the current run-off rate.

2.11 The Ramsey County Master Street Plan identifies Lexington Avenue as a future 99
foot right-of-way. An additional 16.5 feet of right-of-way will be required along the
western edge of this parcel. It has not been the policy of the City to require
dedication of additional right-of-way as a condition of variance approval.

2.12 The corner of Lexington Avenue and Roselawn Avenue has been identified as a
Cornerstone intersection and concepts for redevelopment of this corner have been
developed. While the proposed expansion of this use does not comply with some
of the provisions of the Cornerstone concept, it is consistent with the concept of
keeping local service shops within residential neighborhoods. Guidelines for
development in Cornerstone areas have been developed; however, they have not
been adopted by the City Council.

2.13 Mr. Johnson is also requesting a variance from Section 1009 of the City Code to
reduce the front yard setback of a pylon sign to 5 feet for the purpose of upgrading
an existing sign. The pole for the existing pylon sign is located five feet from the
property line; however, the sign itself extends up to the property line along
Lexington Avenue. Mr. Johnson is proposing to use the existing single pole as the
western pole of the new two-pole sign. The new sign will be 8 feet wide and
approximately 8 feet in height. The overall height of the sign will be approximately
16 feet.

PF#3029 - RPCA (07/08/98) - Page 3 of 6
