<br /> <br />~ <br /> <br />REQUEST FOR COUNCil ACTION <br /> <br />City Manager: <br /> <br />DATE: 10/11/99 <br />ITEM NO <br />Agenda Section: <br />CONSENT <br /> <br /> <br />1.0 <br /> <br />REQUESTED AalON <br /> <br />1.1 <br /> <br />David Johnson, owner of Suburban True Value Hardware located at 1930 Lexington <br />Avenue North is requesting an amendment to the grant to complete sidewalks and street <br />tree improvements as approved in February 1999. <br /> <br />2.0 <br /> <br />8ACKGROUND <br /> <br />2.1 <br /> <br />Mr. Johnson received a variance from Section 1005.01(A) of the City Code to reduce the <br />rear yard setback to 3 feet and the side yard setback to 4.5 feet for the purpose of <br />constructing a 75' x 25' (1,875 square feet) addition to an existing 4,625 square foot <br />~ building (6.500 square feet total with addition) on September 14, 1998. Staff was directed <br />to work with Mr. Johnson to see that sidewalks were installed along both frontages, if <br />possible. <br /> <br />2.2 <br /> <br />In addition, Council approved a grant and business loan to Mr. Johnson for the <br />improvements needed to complete sidewalk and landscape improvements in the city right <br />of way along Lexington and Roselawn Avenues. <br /> <br />3.0 <br /> <br />PROPOSED REVISION TO GRANT <br /> <br />3.1 <br /> <br />After review, City staff determined that the sidewalk along Roselawn should not be <br />constructed in conjunction with this project because a new city pathway will be <br />constructed on the south side of Roselawn. However, the existing free standing business <br />sign must be removed from the Lexington Avenue right of way to enable the construction <br />of the sidewalk along Lexington Avenue. Due to these changes Mr. Johnson is requesting <br />an amendment to the grant to use the funds allocated to the sidewalk along Roselawn for <br />the removal of the bus' ess sign to enable the construction of the sidewalk along <br />Lexington.
